Terms and Conditions

Effective Date: July 10, 2025

1. AGREEMENT OVERVIEW

These Terms and Conditions (“Terms”) govern the provision of musical services by Saxopan Serenades, operated by Brentford and Brenten Handfield (“we,” “us,” or “the Artist”), and the use of our website saxopan.com (“the Website”). By booking our services or using our website, you (“Client” or “you”) agree to be bound by these Terms.

2. Services

2.1 Musical Performance Services

Live musical performances featuring saxophone, steel pan, guitar, and vocals
Repertoire includes classical, jazz, R&B, soul, reggae, calypso, and contemporary music
Services available for weddings, corporate events, private parties, and special occasions
Performance duration and specific requirements as agreed upon in individual contracts

2.2 Service Area

Primary service area: Turks and Caicos Islands
Additional locations may be available upon request and subject to travel arrangements

3. Booking and Payment Terms

3.1 Pricing

Pricing may vary based on event type, location, and specific requirements

3.2 Payment Schedule

Deposit: 50% of total cost required to confirm and schedule the event
Balance: Due either one week BEFORE or ON the event date PRIOR to performance
Accepted Payment Methods: Cash, e-transfer, or as otherwise agreed upon

3.3 Late Payment

Late payment of the balance may result in cancellation of services
Additional fees may apply for late payment arrangements

4. Cancellation and Postponement Policies

4.1 Client Cancellation

Notice Period: Minimum 30 days’ notice required for cancellation
Refund Policy: 50% of deposit will be refunded for cancellations due to extenuating circumstances only (death, surgery, etc.)
Standard Cancellations: Full deposit is non-refundable for cancellations not meeting extenuating circumstances criteria
Cancellation Notice: Must be provided directly to the Artist via email or phone

4.2 Event Postponement

All reasonable efforts will be made to honor postponed events
We will work with the Client to find a mutually suitable alternative date
Original deposit will be applied to the new date
Additional fees may apply if the new date requires different arrangements

4.3 Artist Cancellation

In the unlikely event we must cancel due to illness, emergency, or unforeseen circumstances, we will provide maximum notice possible
Full refund of all payments will be provided if suitable replacement cannot be arranged

5. Performance Requirements and Client Responsibilities

5.1 Venue Requirements

Outdoor Events: Client must provide adequate protection from sun, wind, and precipitation
Power Supply: Adequate electrical power must be available for equipment
Performance Space: Suitable area for musicians and equipment setup
Access: Reasonable access to performance area for equipment setup and breakdown

5.2 Hospitality

Meal and beverages must be provided for all band members
Meal timing should be coordinated to not conflict with performance schedule

5.3 Repertoire and Special Requests

Special musical selections should be communicated as early as possible
We reserve the right to decline requests that are outside our repertoire or capabilities
Additional preparation time for special requests may incur additional fees

6. Liability and Insurance

6.1 Limitation of Liability

Our liability is limited to the amount paid for our services
We are not responsible for damages due to weather, venue conditions, or circumstances beyond our control
Client is responsible for any damage to our equipment caused by venue conditions or third parties

6.2 Force Majeure

We are not liable for inability to perform due to acts of God, natural disasters, government restrictions, or other circumstances beyond our reasonable control

7. Intellectual Property

7.1 Music Rights

All musical arrangements and original compositions remain the property of the Artist
Client may not record or reproduce our performances without express written consent
We retain the right to use photos and videos of our performances for promotional purposes

8. Website Terms

8.1 Website Use

The Website is provided for informational purposes and service booking
All content is protected by copyright and may not be reproduced without permission
We reserve the right to modify or discontinue the Website at any time

8.2 User Conduct

Users must not misuse the Website or use it for illegal purposes
Spam, harassment, or abusive behavior is prohibited
We reserve the right to terminate access for violations of these terms

9. Privacy and Data Protection

Personal information collected through bookings and website use is governed by our Privacy Policy
We will not share personal information with third parties without consent
Client photos and testimonials may be used for promotional purposes unless otherwise requested

10. Contract Modifications

10.1 Written Amendments

Any changes to performance contracts must be in writing and signed by all parties
Verbal agreements or modifications are not binding

10.2 Terms Updates

These Terms may be updated periodically
Continued use of our services constitutes acceptance of updated terms

11. Governing Law and Dispute Resolution

11.1 Jurisdiction

These Terms are governed by the laws of Turks and Caicos Islands
Any disputes will be resolved through good faith negotiation first

11.2 Severability

If any provision of these Terms is found invalid, the remaining provisions will continue in full force

By booking our services, making a deposit, or using our website, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

These Terms and Conditions supplement and do not replace individual performance contracts. In case of conflict between these Terms and a signed performance contract, the signed contract will take precedence.
